Once again, the Commission on Election rejected the bid for recognition and participation of the Ladlad Party to next year’s congressional race. One of the various reasons for the disapproval was that the claim of the party representative that gays and lesbians is a marginalize sector in the Philippine society is inconclusive or unacceptable. Is this a valid reason for denial?

I really do not have any idea how the Comelec validates and approves sectoral parties for an election but when I heard in the news that the commission rejected Ladlad’s candidacy due to unsupported claims of marginalization of the LGBT in the society, the first thing that comes to my mind is that the commissioner was somehow right.

My concept of marginal sectors of the society are those groups of individuals that have little or no access to social, political, economic, legal benefits and privileges. These are the people with disabilities, the youth, the elderly, the uneducated, the prisoners, etc. Gays and lesbians are not marginal members of the society. They could access all kinds of jobs, education, leisure, etc. They all have equal rights with the rest of the members of the society. Gays and lesbians are in fact still men and women. They are in the House of Congress.

I think using marginalization as a justification to a congressional seat is a poor one. The Comelec must have qualifying criteria how to become a valid Party List. Ladlad could have just accomplished this and do not aggrandize or dramatize its participation. If it lacks qualification, why bother participating in the election? In fact, do they really need representation?

Comelec Marginalization

It is a big question how Comelec marginalized a lot of groups? The practice of Comelec of marginalization is not fair. How can Bantay Partylist of Palparan can be marginalized? As the individuals involved are former ranking and elite members of AFP who are also powerful in social class. While Migrante's individuals are underclass and underprivileged and were more marginalized by Comelec by not honoring the Migrante partylist. The aspiration of this most exploited and abused individuals call people to assail and abhor Comelec. For Ladlad it is their choice to be marginalized but they have all the rights and priviledges. They can be the best or the worst. Name it. General or domestic help. It is their choice.

Ang totoong mga partylist ay talagang mahihirap lamang gaya ng anakpawis at ang bayan. Iyong mga pekeng partylist at may basbas ng malakanyang ay mayayaman. Ito nga ang dapat ipaliwanag ng Comelec. Gaya ng Bantay marami kasing grupo na gumagamit ng pangalan gaya ng mga loyalista ni marcos pero ang Bantay na pinamumunoan ni Palparan ay hindi tunay na mga security guard at alam naman natin kung paano pagsamantalahan ang ating mga kawawang guardia ng mga may-ari nito na karamihan ay mga opisyal ng AFP. Bakit naging partylist ito? na sobra na nga ang kapangyarihan lalo halos gabinete at opisyales ng pamahalaan ay mga retiradong heneral. Ang suporter ng Bantay ay mga PMA'yer at sila rin ang ulo at katawan ng Bantay. Totoo mayaman ang Buhay ni Mike Velarde at paano naging partylist ito kung iisipin na malaking sektor ng grupo ito ay mamayang lahat ng karapatan at prebilihiyo ay mayroon. Majority ng ating mamayan ay Catholic na suporter kuno ng Buhay. Ito ba ay marginalized o underclass?
